The www.adventureworld.com website (including any redirections to or from www.adventureworld.com.au and www.adventureworld.co.nz) (the “Site”) is owned and operated by Adventure World Travel Pty Ltd ABN 69 122 505 631. In these booking terms and conditions the expressions “Adventure World”, “we”, “our” or “us” include Adventure World Travel Pty Limited (A.B.N. 69 122 505 631) and entities that assist or participate with Adventure World Travel Pty Ltd in the provision of the services it agrees to provide (where the context permits, including its and their employee and agents) and the expressions “you”, “your”, “client” or the “passenger” include a person seeking or requiring the services offered by Adventure World, all other persons (if any) included with that person in the booking and that person’s or those persons’ travel agent (if any). The expressions “Operator” or “Supplier” include any company operating a Travel Product in destination or making reservations as authorized by Adventure World. The expressions “services”, “trip”, “itinerary”, “custom itinerary” or “Travel Product/s” includes all services including but not limited to accommodation, transfers, sightseeing, cruises, flights and packages that are listed in your booking with us.
1. YOUR HOLIDAY BOOKING
Please carefully read and ensure you understand the following terms and conditions. You must not make any booking unless you understand and agree with the following terms and conditions.
(a) Travel Products and Availability
By requesting a quote for or booking any services or products (“Travel Products”), you (if booking directly or through a travel agent) and your travel agent on your behalf (if booking through a travel agent) acknowledge and confirm that you have read our booking terms and conditions, that you accept them without reservation as constituting the entire agreement between you and us which cannot be varied other than by an officer of Adventure World in writing.
Bookings of all Travel Products we arrange are provided by suppliers we believe to be reputable and to operate in accordance with the standards set down by their own local authorities. Those Travel Products are provided subject to those suppliers’ terms, conditions and limitations (some of which may exclude or limit liability in respect of death, injury, delay, loss or damage to persons and/or effects) and we accept no responsibility for them nor do we make or give any warranty or representation as to their standard, quality or fitness for any particular purpose. Any legal recourse you may have in respect of those Travel Products is against those suppliers and not against us.
The services we provide to you are limited to (a) the arrangement and coordination of your travel arrangements; and (b) the delivery of travel arrangements which we directly control. This includes (often significant) work undertaken prior to travel to arrange and coordinate the delivery of your travel arrangements.
We recommend all passengers take out adequate travel insurance for the duration of their travel.
All Travel Products shown on our Site may be booked, subject to availability at the time of booking.
Considerable care has been taken to compile the information on our Site but circumstances outside of our control may necessitate changes in itineraries or accommodation (e.g. bad weather, hotel being damaged etc.). We reserve the right to cancel or reschedule departures and itineraries if required by circumstances beyond our control. Where it is necessary to change a hotel, we will endeavour to substitute accommodation of no lesser standard.
(b) Travel Insurance
Travel insurance is recommended for all guests covering all applicable dates of travel with Adventure World. This insurance must cover; trip interruption, personal injury, medical expenses, evacuation, and repatriation cover including during pandemic events. The choice of insurer is yours. Adventure World may receive a commission for introducing you to a travel insurance provider. Adventure World cannot be held responsible for your failure to obtain insurance which is appropriate, and we recommend you purchase your insurance at or soon after booking your trip. Adventure World will not be held liable for any costs incurred by the guest resulting from their failure to obtain adequate travel insurance.
We make no representations as to what you may recover under any insurance. You agree not to hold us responsible for any decision of insurers, and/or any supplier, or the requirements of any foreign government, authority, foreign law or policy.
(c) Force Majeure
Force Majeure Event means any event or circumstance beyond the control of Adventure World, including but not limited to: (a) an act of god (such as earthquake, flood, fire, explosion, landslide, lightning, action of the elements, force of nature, washout, typhoon, hurricane, cyclone, tsunami, storm or storm warning or natural disaster); (b) industrial disputes, work ban or other labour dispute or difficulty; (c) acts of terrorism, political unrest, war or threat of war, riots or civil strife; (d) failure or delays to scheduled transportation and the closure of airports or ports; (e) pandemic, epidemic or health risk; (f) governmental and administrative actions (including closure of borders and travel warnings and restrictions).
(d) COVID-19
An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the WHO senior citizens and guests with underlying medical conditions are especially vulnerable. We ask that you please take personal responsibility for your wellbeing. This begins with packing any personal protective equipment and sanitisers you require. Please adopt physical distancing and hygiene practices throughout your pre-trip travel arrangements and follow all health instructions whether physical signage, or requests from our professional staff, once you are holidaying with us. To travel with Adventure World, you voluntarily assume all risks related to exposure to COVID-19.
(e) International Travel
You are responsible for all immigration, passport, visa, health, quarantine and customs laws, regulations, orders, demands, fees or other requirements of countries visited or transited. You should check the requirements of those countries with their embassies or consulates or other authorities.
Adventure World bears no responsibility for such information and will not be responsible for advising and/or obtaining required travel documentation for any guest, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.
Please note that entry to any country may be refused even if the required information and travel documents are complete. Adventure World will require full passport information (full name, date of birth, passport number, Nationality, issue and expiry dates) prior to final payment in order to secure Travel Products for many itineraries.
We strongly recommend that you review official travel advice provided by your government prior to making your booking and prior to departure.
2. our site
By using the Site to browse any Travel Product, you represent to us that you have read our User Agreement posted on the Site and you accept its application to you.
(a) Prices on the Site
We endeavour to ensure the accuracy of all prices displayed on the Site. Prices are:
(i) specified in New Zealand dollars (unless stated otherwise) and are subject to change without notice;
(ii) indicative only and subject to change until all of your booking details have been provided to us, we have confirmed your booking and you have paid in full; and
(iii) for the number of persons, items or time periods and on the conditions stated on the relevant page of the Site.
The expression “from” with respect to a price means the lowest price for the Travel Product we believe is available at the time of publication, based on information we have received from suppliers.
3. FLIGHT RESERVATIONS
Airfare prices and conditions are subject to change or withdrawal without notification until the airline tickets are issued (For example, foreign currency airfares and airport taxes may fluctuate and are subject to the rate of exchange on date of ticket issue). Full payment is required before tickets can be issued.
Adventure World is not responsible for any increases in prices or changes in any airfare prices.
If we have knowledge of any potential airfare increases, we will advise you when confirming your booking.
(a) Airline Schedule Changes
Itinerary changes due to flight delays and schedule changes is solely under the airline’s control. Adventure World reserves the right to offer alternative schedules for itineraries affected by airline schedule changes and equipment. Flight delays, flight cancellations and schedule changes are the responsibility of the airline. Adventure World will not be responsible or liable for such delays or rescheduling and extra charges.
(b) Airline Seating
Not all airlines offer pre-assigned seats. Some may charge for pre-assigned seats. Seat assignments are not guaranteed and are subject to change without notice due to a schedule change, equipment change or other unforeseen circumstances. Seating is solely under the airline’s control. Any additional charge imposed by airlines will be at guests’ expense. Where pre-assigned seats are not offered or different seats are desired, guests must contact the airline(s) directly to arrange seating assignments as well as special meal requests. Adventure World does not assure that these requests will be granted.
3. FLIGHT RESERVATIONS
Please contact one of our Destination Experts who will work with you to arrange an experience customised to your needs. We will present to you written quotation for the Travel Products requested.
You must ensure names used to make a booking are exactly as appear in passports. Any name/initial or spelling changes made after booking confirmation may result in supplier imposed fees and/or you being unable to travel.
(a) Quotes
All written quotes indicate the current price for the Travel Products only, they do not, unless specified, indicate the availability of the Travel Products.
(b) Exclusions
The price does not include airfares (unless otherwise stated), passport and visa fees, insurance, laundry, phone calls, beverages, meals not detailed in the itinerary, tips to tour guides, motor coach drivers and local city guides, items of a personal nature, excess baggage, expenses, fees or costs incurred in case of illness, or of refusal of entry to, detention in, or expulsion or repatriation from a country or part of a country. We are not liable for any expense, costs or loss incurred in relation to such matters and you release us from all liability, damages or responsibility in relation to them.
(c) Deposit
Upon receiving instruction from you that you wish to acquire Travel Products, we will, arrange (if available) the quoted Travel Products and provide you with a confirmation of their availability and pricing. Your instructions will constitute confirmation that you have checked the Travel Products being booked and you have read, understood and agreed to these booking terms and conditions and any terms and conditions specified in the quote.
You must, pay to us:
(i) a deposit of 25% of the total booking value within 5 business days of us confirming availability and pricing of the Travel Products you request; and
(ii) all advance payment amounts we notify you with that confirmation or from time to time in respect of the Travel Products you request and within the time we notify you (e.g. certain Travel Products may require a further payment, up to full payment, to confirm the booking).
A travel agent who makes a booking at your request is your agent and is not our agent for the purposes of receipt of the deposit or any part of the price.
(d) Special Requests
If you have any bedding requests, dietary requests, allergies or any other special requests, please advise us at the time of booking. Although we will endeavour to pass any reasonable requests on to the relevant supplier, this is not confirmation that the request will be met. All requests are subject to availability.
(e) Final Payment
The balance of the price of your booking must be paid no later than 90 days before (or at any time stated by us) your departure. If you fail to make any required payment, we will assume your booking is cancelled.
For bookings within 90 days of departure, full payment is required at the time of request. You acknowledge that we may not be able to confirm services, in which case we will provide you with a refund.
Final documentation will be provided to you as soon as reasonably practicable following receipt of payment in full, all Travel Products being fully confirmed and receipt of all other information required from you, such as emergency contact details or booking registration. Please be aware that depending on the Travel Products included in your custom itinerary, some elements of final documentation may be issued directly by our suppliers according to their own timeline & distribution method.
(f) Taxes, Charges and Currency Fluctuation
All Government taxes and charges imposed by suppliers or third parties (including ticketing fees and airline fuel surcharges) are payable by you and are subject to change. If there are any increase in such taxes, charges or supplier rates or any currency fluctuation which increase the price of your booking, we reserve the right to change the price you must pay by including the additional charges or amount (together with any applicable service fee and GST) at any time prior to and including the date of your departure, even if we have received full payment from you.
We will notify you of any such price changes that result in your travel arrangements being materially different from those prior to the change being effected and in respect of which we have already accepted your deposit or full payment. If so, and you do not wish to alter your travel arrangements, you may cancel them and monies you have already paid, less cancellation fees outlined below, will be refunded. Any refund will be calculated at the currency exchange rate that applied when your booking was confirmed.
5. PRIORITY PROCESSING
For all booking requests made within 21 days of departure, Adventure World reserves the right to refuse the booking for any reason. If we choose to process the booking, a $100 priority processing fee will be charged and full payment will be required before any reservations can be made. You acknowledge that we may not be able to confirm services, in which case we will provide you with a refund.
6. CREDIT CARDS
Any payment by credit card attracts a non-refundable service fee at time of payment, based on the total cost of the payment. The amount of this service fee will depend on the credit card used and will be advised at time of payment.
7. BOOKING CHANGES
If you amend your booking after it has been confirmed, you must pay to us:
(i) an administration fee of $100, to cover communication and administration costs; and
(ii) any cancellation and/or amendment fees imposed by suppliers such as accommodation providers and other suppliers.
3. CANCELLATION & REFUNDS
(a) Cancellation by You
If you cancel your booking after it has been confirmed, but before you utilise the Travel Product, you must pay to us the total of:
(i) 15% of the booking value to compensate us for work performed up until the time of cancellation (including work performed in connection with your travel arrangements prior to your booking) and also for processing and arranging the cancellation and any associated refund.
(ii) all cancellation fees imposed by the suppliers of your Travel Products (including airlines),
and we will retain and apply the deposit and all payments you have made to us on account or in payment of that total.
Supplier cancellation fees will vary depending on which Travel Products are included in your custom itinerary. Travel Products that are promoted or discounted by suppliers generally attract a higher cancellation fee.
Below is an indication (based on date of cancellation and your total booking value) of the total cancellation fees (ours and Travel Product suppliers) that will apply:
More than 90 days before departure: Deposit plus any advance payments
61-90 day prior to departure:50% of the total booking value
31-60 days before departure:75% of the total booking value
30-0 days before departure: 100% of the total booking value
Travel/transport providers (such as airlines and rail travel) generally impose a 100% cancellation fee once a booking is made.
These charges are subject to the trading terms of suppliers and may be higher or lower according to the Travel Products included in your custom itinerary.
If you are considering cancelling all or any of your Travel Products, please contact us for details of the supplier cancellation fees. When processing your cancellation, we will assess the cancellation fees imposed by the suppliers of your Travel Products and will mitigate fees wherever possible.
Cancellation fees and charges will not exceed payments received by us at the time of cancellation. If after the application of these fees and charges there is a surplus of payments you have made to us, we will refund this to you within a reasonable time.
Any payments we have made to third parties will only be refunded to you once we have deducted the above cancellation fees and charges and once we have actually recovered the amounts from the third parties. We will use reasonable endeavours to recover third party payments, but we make no guarantee that we will be able to make recoveries.
After your travel has commenced, there can be no refund in respect of any Travel Product not utilised whether by choice or because of late arrival or early departure, including failure of a transport to operate according to schedule. Employees of any supplier are not authorised by us to give any undertakings in respect of refunds or other matters.
You agree that these cancellation fees and charges are reasonable and required to protect our legitimate business interests.
(b) Cancellation Due to Failure to Pay
If payment is not received by the due date/s, Adventure World has the right to cancel your reservation and no refund will be made. Adventure World will not be responsible for lost land and/or air reservations.
(c) Cancellation Due to Force Majeure Events
If Adventure World cancels a trip as a result of a Force Majeure Event, a future travel credit (FTC) to the value of funds paid to date less any third-party costs incurred will be provided. All FTCs will be valid for 24 months from date of issue.
Where a trip is terminated mid-trip due to a Force Majeure event, if we provide you with any alternative or additional services or assistance (such as hotels or travel) then you agree to pay for these costs.
(d) Cancellation Due to Events Other Than Force Majeure Events
If the cancellation by Adventure World is not as a result of a Force Majure Event, Adventure World will provide an alternative comparable Travel Product (if available). If an alternative is not available then a refund can be made. Adventure World is not liable for any cancellation or change cost or penalties incurred on other travel arrangements, including air travel, that may be affected thereby.
Adventure World is not responsible for other travel arrangements that you or your party have made outside Adventure World and which are affected by our cancellations.
Adventure World reserves the right, to modify or cancel any trip (definite or not), accommodation, in-destination activity or arrangement at any time.
(e) Early Return, Illness or Absence
Early return expenses are the guest’s responsibility. There is no refund for absence or early departure from a Travel Product, including but not limited to missed hotels, transfers, meals or sightseeing cruises. Adventure World urges you to purchase travel insurance which covers such circumstances. Adventure World makes no representation or guarantees concerning reimbursement, scope of coverage, or other aspects of any travel insurance policy or claim.
3. GENERAL INFORMATION AND CONDITIONS
(a) Age Restrictions
Young travellers under 18 years of age must be accompanied by an adult, who will be responsible for their welfare and supervision. Adventure World is not responsible for any losses if you fail to have appropriate documentation. Countries have different age limits for the consumption of alcohol and other activities. You must ensure you satisfy the age limits before participating in any activity with age limits (such as the consumption of alcohol) and you release us from all liability and claims arising from your inability to participate in such activities.
(b) Trip Participation
All Travel Products are operated by independent third party suppliers. Your contract will be with the operator of the experience. We are not responsible for providing the experience, or anything that happens during the experience. Some experiences involve outdoor activities and/or can be physically demanding and may require signature of a waiver. You must make your own decisions about experiences and participate only in activities that suit your physical ability: we suggest that you speak with your medical provider if you have questions about your abilities. We recommend you check whether any insurance you have also includes your participation in adventure activities you may undertake. Adventure World nor any of its related entities will accept any liability for your state of health or any consequences related to your participation in the Travel Products included in your custom itinerary.
(c) Behaviour
When you make a booking, you accept responsibility for the proper conduct of all members of your party during your Travel Product. We reserve the right at any time and at our discretion to terminate the travel arrangements and/or cease to deal with any party member(s) whose behaviour, in the reasonable opinion of us or our suppliers, may cause danger, upset, disruption or distress to anyone else or damage to property. Full cancellation charges will apply and no refund will be made. We shall have no obligation to pay compensation or meet any costs or expenses (including but not limited to alternative accommodation and return transportation arrangements) guest may incur as a result of the travel arrangements being terminated.
You must immediately report any pre-existing damage in your room to accommodation staff. If you damage the accommodation in which you are staying or any property, you must reimburse the accommodation provider or property owner concerned for the cost of the damage before the end of your stay if the cost has been established by then or as soon as it has been established if later. You must indemnify us for the full amount of any claim (also including legal costs) made against us. Criminal proceedings may be instigated. Adventure World is not responsible for any costs incurred concerning a guest removed from a trip or aircraft, ship or train. Guests agree not to hold Adventure World or any of its related entities liable for any actions taken under these terms and conditions.
10. RESPONSIBILITY
We arrange the provision of Travel Products which are provided by third party suppliers. We do not ourselves provide the Travel Products you may receive on your holiday.
(a) Suppliers Terms and Conditions
Supply of the Travel Products is made, and all itineraries, coupons and exchange orders (collectively “vouchers”) are issued to you, upon the supplier’s terms and conditions that are then in use, including as to the applicable laws, requirements and policies of any government authority related to, among others, visas, entry, exit or transfer requirements. Your acceptance of the vouchers constitutes those terms and conditions as the entire agreement between you and the relevant supplier and you bear all costs or losses incurred as a consequence of your failure to comply with them.
(b) Exclusion of Liability
To the maximum extent permitted by law, neither Adventure World nor the Supplier nor its agents or affiliated entities (“released parties”) shall be responsible or liable for cancellations, acts of other service providers, diversions or substitution of equipment or any act, variation, postponement, omission or default by air carriers, land carriers, hoteliers or hotels, transportation companies, or any other persons providing services or accommodations to guests including any results thereof, such as changes in services, accommodations or facilities. Nor shall they be liable for loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss (including consequential loss), negligence or delay from the act, error, omission default or negligence of any person not its direct employee or under its exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer or employee. The released parties shall not be liable for indirect, special or consequential damages.
All baggage and personal effects are at all times and in all circumstances at the risk of the trip participant. All certificates and other travel documents for services issued by Adventure World are subject to the terms and conditions specified by the carriers and suppliers and to the laws of the countries in which the services are supplied. Carriage by sea is subject to the Carrier’s Conditions of Carriage which are expressly incorporated into this contract, copies of which are available upon request. The released parties are not responsible for any criminal or other conduct by third parties, whether criminal, intentional, grossly negligent, negligent or otherwise.
We are not responsible for any criminal conduct of any third party.
Additional risks may arise including, but not limited to, hazards of traveling in undeveloped areas, hazards of travel by boat, train, bus, car, truck, aircraft and other means, animals, forces of nature, unrest, differing levels of sanitation, differing safety standards, risks associated with water, drinks, food, plants, insects and animals, diseases and transmission of disease to you or members of your family or party, accident or illness in areas of difficult evacuation or poor medical facilities, acts of governments; all occurring during the trip or while coming to or returning from the trip. You are voluntarily participating, knowing there are risks. You agree to accept any and all risks. You release and discharge Adventure World, its related companies and personnel from, and agree not to make a claim against any of them for any and all claims, known or unknown, arising from contracting for, traveling to or from, or traveling during, and in any and every way participating in a trip, even where caused by negligence of any of these released and discharged persons and entities. This release and discharge of liability, assumption of risk and agreement not to make a claim is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns.
(c) Safety
Where the guest occupies a motorcoach seat fitted with a safety belt, neither Adventure World nor the Operator nor its agents or co-operating organisations or service providers will be liable for any injury, illness or death or for any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident. This exclusion and limitation of liability shall not be used to imply that the Operator or its agents or affiliated entities are liable in other circumstances.
(d) Warranties
To the extent permitted by law, all express and implied warranties, guarantees, representations or terms are expressly excluded.
Where the law implies any warranty guarantee or condition which cannot be excluded, our liability to you for breach thereof is limited to supplying the services again or payment of the cost of having the services supplied again.
(e) Maximum Liability
Despite any other provision of these terms and conditions, to the extent permitted by law, our maximum liability to you or any third party is limited to the price you have paid us for the booking.
(f) Unlicenced Supplier Disclaimer
Adventure World’s range of products have been refined over 40 years. If you request Adventure World to arrange Travel Products by a person or company which is not licensed in accordance with any applicable law, we accept no liability (whether in contract for negligence or otherwise) for any loss or damage suffered by you as a result.
(g) Errors and Omissions
In the case of computer or human billing errors, we reserve the right to correct any errors in fees, charges, rate or prices quoted or billed, even if we have received full payment from you.
Every effort is made to accuracy of our brochures and website; however, Adventure World cannot be held responsible for printing or typographical errors, or errors arising from unforeseen circumstances. Moreover, photographs and descriptions of locations or attractions are merely representative of conditions that existed at time of brochure printing and conditions may not be the same at the time of your journey.
The airline(s) featured or nominated in our brochures or website do not by virtue of their endorsement commit or represent themselves either as contracting with any purchaser of a vacation from Adventure World or as having any other legal relationship with them.
All bookings made with any provider of any transport, facilities, meals, other goods or of any services are subject to terms and conditions and exclusions and/or limitations of liability imposed by them in relation to matters not covered particularly and expressly by your agreement with Adventure World.
If you decide that you do not want to visit a country or part of a country you intended to visit because of any law, condition or requirement of any government or governmental authority, official, servant or agent, you are responsible for any costs, expenses, charges, fees, losses or damage incurred as a consequence and any cancellation or amendment fees. None of the companies in the Adventure World group of companies, or any of their staff or agents, accept any responsibility or liability for your acts, omissions, defaults, conduct, state of health, condition or circumstances.
11. COMPLAINTS
We endeavour to ensure that the arrangements we have made for you are implemented as arranged. If a problem occurs, the most practical way to deal with it is attempt resolution with the supplier. If you fail to follow this course, any claim for compensation may be reduced or denied. If you have any unresolved complaint, details should be lodged in writing (with supporting documentation, including efforts made with the supplier to resolve it) with your travel agent or directly with us within 30 days of your holiday concluding.
12. PRIVACY
To process your trip booking, Adventure World will need to use personal information for you and guests in your booking. Personal information may include each guest’s name, address, phone number, email address, passport number, and sensitive information such as health, medical, dietary, mobility, religious or other special requirements. This personal information may be passed on to other suppliers of your travel arrangements in addition to public authorities (such as customs and immigration), security and credit checking organisations, and otherwise as required by law. We may need to provide personal information to contractors who provide services to or for us (e.g. sending mail, providing marketing assistance, etc). This may involve sending personal information (including sensitive information) to other countries that may not afford the same level of protection of personal information. In making your booking, you consent to your personal data being passed to relevant third parties as set out above.
You consent to our, our agents and related entities to collecting, retaining, using and disclosing your personal information in accordance with our Privacy Policy. Our Privacy Policy sets out how we manage your personal information and is available on our website at www.adventureworld.co.nz, or can be sent to you on request. Your booking of any Travel Product constitutes your representation to us that you have read our Privacy Policy and accept its application to you.
13. LAW AND JURISDICTION
The agreement between us and you in respect of the services to be provided is constituted solely by these terms and conditions and is governed by the laws of New Zealand. We and you submit to the exclusive jurisdiction of the Courts of New Zealand and the Courts of appeal therefrom. In any legal action, arbitration, or other proceeding to enforce, interpret or construe the terms [of this Agreement/and conditions], or concerning any grievance relating to the [cruise/tour/holiday/booking], the prevailing party shall be entitled to recover its reasonable legal fees and expenses on a solicitor/client basis.
14. UNDERSTANDING THESE TERMS AND CONDITIONS
If you do not understand any aspect of these terms and conditions you should seek advice from an appropriately qualified person.
